DOĞAL AFETLER VE ULUSLARARASI HUKUK: AFET DURUMUNDA KİŞİLERİN KORUNMASINA İLİŞKİN TASLAK MADDELER VE İNSAN HAKLARI

Abstract

Uluslararası hukukun, yakın zamana kadar doğal afetler konusunda somut bir zemin sağlamak bakımından dağınık ve sistemsiz bir karakter arz ettiği görüşü hakimdir. Bu hukuk dalı bakımından doğal afetler konusu uzunca bir süre insancıl yardım ve destek bağlamıyla sınırlı kalmış ve egemen devletler bu yönde hak ve yükümlülük taahhütleri altına girmekten imtina etmişlerdir. Ne var ki, doğal afetlerin son yıllarda dünya genelinde giderek artan görünümü, uluslararası hukuk mekanizmalarını bu yönde yeni ve hak temelli arayışlara yöneltmiştir. Bu bağlamda uluslararası insan hakları hukukunun sağladığı standart ve güvenceler kilit bir rol oynar niteliktedir. Nitekim insan hakları temelli bir yaklaşım, Uluslararası Hukuk Komisyonu’nun yakın zamanlı bir çalışmasının ürünü olan Afet Durumunda Kişilerin Korunmasına İlişkin Taslak Maddeler’de açık bir biçimde gözlemlenebilmektedir. Bu çalışma, uluslararası afet hukukuna ilişkin mevcut enstrümanları tarihsel olarak ele almanın akabinde, çalışmanın başlığına konu olan Taslak Maddeler’in kısa bir değerlendirmesini sunacaktır.
