Criminal Procedure Code No. 5271 (CMK) regulates judicial search and seizure issues in line with the principles laid down by the Constitution. In the case of a search by the decision of the competent authority without a judge's decision, the constitutional provisions that this decision is submitted to the approval of the judge are not included in the CMK. For this reason, whether it is necessary to give a decision to approve the search warrant by the judge is debatable in doctrine and judicial decisions. In the doctrine, some authors stated that it is not necessary to submit the search warrant given in this situation to the approval of the judge. Some authors also stated that the provisions of the Constitution have the ability to be applied directly, and it was concluded that the search warrant should be submitted to the approval of the judge. When the subject is examined in terms of high judicial decisions, it is seen that the comments made by the first-instance courts on the subject are out of the scope of the review. In this study, opinions in the doctrine and judicial decisions will be evaluated.
Judicial search submission of the search warrant to the judge approval of the search direct applicability of the Constitution Legislative Neglect
5271 sayılı Ceza Muhakemesi Kanunu (CMK), Anayasa’nın koymuş olduğu ilkeler doğrultusunda adli arama ve elkoyma konularını düzenlemektedir. Hâkim kararı olmadan yetkili merciin kararı ile arama yapılması durumunda bu kararın hâkimin onayına sunulması yönündeki Anayasa hükümlerine CMK’da yer verilmemiştir. Bu nedenle hâkim tarafından arama kararının onaylanmasına ilişkin karar verilmesinin gerekli olup olmadığı doktrin ve yargı kararlarında tartışmalıdır. Doktrinde bir kısım yazar, bu halde verilen arama kararının hâkim onayına sunulmasının gerekli olmadığını belirtmiştir. Bir kısım yazar da Anayasa hükümlerinin doğrudan uygulanma kabiliyeti bulunduğunu ifade ederek arama kararının hâkim onayına sunulması gerektiği sonucuna ulaşmıştır. Yüksek yargı kararlarına bakıldığında, ilk derece mahkemelerinin bu konu ile ilgili olarak yapmış olduğu yorumların inceleme dışında kaldığı görülmektedir. Bu çalışmada doktrindeki görüşler ve yargı kararları değerlendirilecektir.
