Asıl adı Hamza olan Sarıgürz (Sarıgörez) Nûreddin b. Yûsuf Balıkesirli bir Osmanlı âlim ve fakihidir. İstanbul’da eğitimini tamamladıktan sonra müderris olmuş ve ardından Sahn-ı Semân medresesi müderrisliği payesini elde etmiştir. 917 (1511)’de İstanbul kadısı olmuş ve Sultan II. Bayezid döneminde devlet işlerinde görev almıştır. 919 (1513)’de Yavuz Sultam Selim devrinde Anadolu kazaskerliği ve 921 (1515)’de Rumeli kazaskerliğine tayin edilmiş, ertesi yıl da azledilmiştir. 926 (1519)’da tekrar İstanbul kadısı payesi ile yeniden Sahn-ı Semân müderrisi olmuştur. 928 (1522)’de İstanbul’da vefat etmiştir. Sarıgürz, Arap dili ve belagati, kelam, fıkıh gibi İslami ilimler alanında kitap ve risaleler kaleme almıştır. Çalışmamızda onun fıkıh alanında Hanefî mezhebini esas alarak hazırlanmış kitaplardan derlediği meselelerden oluşan ilmihal niteliğindeki muhtasar fıkıh kitabı el-Murtazâ’daki ictihad ve fetvalar ile ilgili bazı tespit ve değerlendirmelere yer verilmiştir. Bu çerçevede kitabın müellife nisbeti, muhtevası ve üslubu ile temizlik, namaz, zekât, hac, oruç gibi ibadet konuları, inanç esasları ve muâmelât kapsamında yer alan çok sayıda mesele değerlendirme kapsamında yer almıştır. Söz konusu konularla ilgili ictihad ve fetvalarda dayanak olarak kitap, sünnet, icmâ, kıyas, istihsan gibi şer’î delillerin esas alındığı, bununla birlikte ihtiyat, kaçınılmazlık, zorluğun kaldırılması, kolaylık, örf-âdet, zamanın değişmesi, fitne gibi gerekçelerle bazı fıkıh ve usul kaidelerinin dikkate alındığı görülmektedir.
Sarıgürz (Sarıgörez) Nûreddin b. Yûsuf was an Ottoman scholar and faqīh from Balıkesir and his real name was Hamza. After completing his education in İstanbul he became a muderris (professor) then he was promoted to be muderris of Sahn-ı Semân school. He became a qadi (Muslim judge) of Istanbul in 917 (1511) and he worked for goverment’s duties in the era of Sultan Bayezid II. He was appointed to be a qadi asker (judge of the army) of Anatolia in 919 (1513), then to be a qadi asker of Rumeli in 921 (1515) but the following year he was dismissed. He worked as a qadi of Istanbul in 926 (1519) and muderris of Sahn-ı Semân school. He passed away in İstanbul in 928 (1522) and he was buried in the tomb of masjid which was built by him and named by his name. Sarıgürz wrote books and treatises in the field of Islamic sciences such as Arabic language and rhetoric, kalam and fiqh. In our study, on the basis on Hanafi school, some determinations and evaluations about the jurisprudence and fatwas in al-Murtezâ, the concise book of catechism, which he wrote based on the Hanafi sect in the field of fiqh, are included. In this context, the book's proportion to the author, its content and style, as well as the subjects of worship such as cleaning, prayer(salat), alms(zakat) pilgrimage (hajj), fasting (sawm), the principles of belief and many issues within the scope of treatment (muamalat) were included in the scope of the evaluation. While ijtihads and fatwas related to the aforementioned issues are based on shar'i evidences such as the book, sunnah, ijma, qiyas, istihsan, some fiqh and legal arguments for reasons such as prudence, inevitability, removal of difficulties, convenience, custom, change of time, fitna. It is seen that the rules of procedure are taken into account.
