Antik Atina'da Hukuk ve Ekonomik Büyüme

Abstract

Polis dergisinin Ocak 2022 sayısında, Eskiçağ tarihçisi Edward M. Harris’in bu çeviriye konu olan kitap incelemesi yayınlandı. Profesör Harris, yaptığı incelemede Federica Carugati’nin Creating a Constitution başlıklı çalışmasını ele alıyor. Çalışmanın literatürdeki konumunu, hayli sert bir eleştiriyle beraber belirlemeye çalışıyor. Öyle ki yaptığı incelemenin nihayetinde vardığı sonuç, bu çalışmanın literatürde önemli bir yeri olmadığı yönünde oluyor. Öte yandan Profesör Harris’in, çalışmanın literatüre katkı sunmadığını düşünmesi, bizi bu çeviriyi yapmaktan alıkoymadı. Bunun iki sebebi var. Bunlardan ilki, eserde Carugati’nin çalışması eleştirilirken aynı zamanda bilhassa Atina demokrasisi hakkındaki güncel literatürdeki kimi önemli eserlerin okuyucuya tanıtılıyor oluşudur. Literatürün bu ele alınış biçiminin, özellikle kariyerinin başındaki araştırmacılara faydalı olacağını düşündük. Bununla bağlantılı ve ikinci olarak kitap incelemelerinin yaygınlaşmasına katkıda bulunmayı amaçladık. Zira özenle yapılmış bir kitap incelemesi hem potansiyel okuyucuya literatürü tanıtmakta hem de bilimsel eleştirinin ve yanlışlanabilirliğin imkanını ortaya koymaktadır.
Anayasa teorisi, anayasa tarihinden soyut düşünülemez. Anayasa tarihiyse kuruluş, teşkilatlanma ve yönetimin, bir diğer deyişle devleti oluşturan kurumların tarihidir. Bir toplumun teşkilatlanması ve geliştirdiği siyasa ile toplumdaki ekonomik gelişmeler arasında bir etkileşim vardır. Çevirisini yapmış olduğumuz kitap değerlendirmesinin konu edindiği eser, Antik Yunan toplumunda ekonomik ilişkilerle siyasa arasındaki etkileşimi açıklama gayesini taşımaktadır. Kitap değerlendirmesindeyse yazarın savları, literatürde bu etkileşimin nasıl belirlendiği hususunda kurulan fikri bağlantılar ile ortaya atılan savların delillendirilme biçimleri ele alınmakta ve tartışılmaktadır. Çevirmen olarak bizler, Anayasa tarihinin liberal anayasacılık hareketleri ve bununla bağlantılı gelişmelerden yahut anayasa değişikliklerinin izlenmesinden ibaret olmayabileceğini göstermek bakımından bu çeviri eserdeki tartışmaların önem taşıdığını düşünüyoruz. Siyasal teşkilatlanma ve ekonomik yapı ilişkisinin tarihinin, demokratik kurumların gelişiminde oynadığı bir rol olduğu tezi üzerine etraflı tartışmaların yapıldığı bu çalışmayı, Anayasa tarihi bakımından incelenmeye değer buluyor ve Türk Anayasa Hukuku literatürünün istifadesine sunuyoruz. İfade edilen konuların önemine dikkat çekmek için kitap değerlendirmesinin çevirisini yapmayı tercih etmemizin bir sebebi elbette var. Şöyle ki, Anayasa Hukuku teorisi kurmak, tarihsel ve kültürel bağlam ile bunlar çevresinde yükselen düşünceler, akımlar, önemli şahsiyetler ve siyasi teşkilatın kuruluşu ve gelişmesiyle ilgili atılmış adımlar arasında doğru ilişkilendirmeyi kurmayı gerektirir. Bu da sayılan veriler arasında kurulan ilişkiler üzerine spekülatif tartışmalar yapmayı zorunlu kılmaktadır. Sonraki bölümde çevirisi yer alan kitap değerlendirmesi, demokratik kurumlar ve ekonomik gelişmeler arasında kurulan bağlar üzerine eleştirel yaklaşımları ve tartışmaları güncel literatür eşliğinde sunması bakımından, bu anlamda örnek teşkil etmektedir. Bu verimli inceleme, Türk yazınında eleştiri kültürüne mütevazı bir katkıda bulunduğu takdirde, çeviri hedefine ulaşmış olacaktır.
