Abstract

Bu çalışma, II. Meşrutiyetten Cumhuriyete geçiş sürecinde yaşanan yoğun tartışma ortamında din-hukuk ilişkisi ve İslam hukuku olanında ileri sürülen bazı düşüncelere dikkat çekmeyi, yaklaşımları orijinal bulunan iki hukukçunun görüşlerini tanıtmayı amaçlayan didaktik nitelikli bir yazıdır. Gerek Mansurizade gerekse Seyyid Beyin kendi eserlerinden hareketle özellikle İslam hukuk zihniyetinde değişme ve yenilenme konusundaki kanaatleri ön plana çıkarılmaya çalışılmıştır. Giriş kısmında II. Meşrutiyet dönemindeki din anlayışlarına, İslam hukuku ve ictihad müessesesi hakkındaki yaklaşımlara temas edilmiştir.

A Section from the Discussions on the Islamic Law in the II Constitutional Period, Mansurizade Said and Seyid Bey Case

Abstract

This study was a
didactic article that is aiming to draw attention to some of the ideas put
forward in religion-law relation and Islamic law in the intense debate
environment during the transition period from II. Constitution to Republic  and 
also aiming to introduce the opinions of two lawyers whose approaches
are original.It is tried to put forward both  Mansurizade and
Seyyid Bey’s opinion on the subject of change and renewal, especially in the
Islamic law mentality, based on their own works. In the introduction part, their attitudes towards
Islamic law and the Ictihad institution have been touched upon during the II.
