Abstract

Since the beginning of the human journey, human beings have produced various tools to survive and facilitate life which has laid the foundation of modern technology. From the most primitive tools of ancient human history like nails and wheels to today's computers and artificial intelligence systems, the world has witnessed countless inventions and immense development in technology. In fact, it has become possible to enhance humans mentally and physically thanks to advanced gene technologies. The issue has gone far beyond seemingly innocent aims of preventing or curing diseases to ensure a healthier and prosperous life. It has turned into a search for immortality on earth and endless life expectancy. The fact that DNA can easily be interfered with through gene editing techniques such as CRISPR-Cas9 has brought along multifaceted and complex problems that need to be examined not only from a legal, philosophical, and moral perspective but also from Islamic law (fiqh) perspective too. This study focuses primarily on using gene editing technology for enhancement purposes and aims to evaluate the issue from a fiqh perspective. First, it puts forward the ethical discussions on the subject. Then it examines the topic on the axis of Islamic law.

TEKNOLOJİ GELİŞTİREN İNSANDAN TEKNOLOJİNİN GELİŞTİRDİĞİ İNSANA -GENETIK MÜDAHALE İLE İNSAN GELİŞTİRMEYE ETİK VE FIKHÎ BAKIŞ-

Abstract

İnsanoğlu yeryüzü hikâyesinin başladığı günden itibaren varlığını sürdürebilmek ve hayatını kolaylaştırmak üzere tabiata müdahale ile çeşitli aletler üretmiş, böylece modern teknolojinin ilk temellerini atmıştır. Kadim insanlık tarihinin çivi, tekerlek gibi en ilkel araçlarından günümüzün bilgisayar ve yapay zekâ sistemlerine uzanan bu süreçte sayısız icat gerçekleştirilmiş, teknolojide akıl almaz gelişime tanık olunmuştur. Öyle ki günümüzde ileri düzey gen teknolojileri ile insanın fiziksel ve mental olarak geliştirilmesi mümkün hale gelmiştir. Mesele, insanın hastalanmasını önleyici girişimlerde bulunma, maruz kalınan hastalıkları tedavi ederek daha sağlıklı ve müreffeh bir hayat yaşamayı gerçekleştirme gibi masum görünen amaçların çok ötesine geçip yeryüzünde ölümsüzlük arayışı ve sonsuz bir yaşam beklentisine dönüşmüş haldedir. CRISPR-Cas9 benzeri gen düzenleme teknikleriyle insan DNA’sına kolaylıkla müdahale edilebilir olması ahlâkî, felsefî, hukukî olduğu kadar fıkhî açıdan da ele alınmayı gerektiren çok yönlü ve karmaşık sorunları beraberinde getirmiştir. Bu çalışma özellikle gen düzenleme teknolojisinin geliştirme amaçlı kullanımına odaklanmış, konuyu fıkhî perspektiften değerlendirmeyi hedeflemiştir. Önce konuyla ilgili etik tartışmalara temas edilmiş, ardından fıkıh ekseninde bir çerçeve çizilmeye çalışılmıştır.
