Borç/Alacak Satışına (Bay’al-Dayn) Dayalı Dış Ticaret Uygulamaları ve Faizsiz Finans Prensiplerine Uyumu

Abstract

İhracatçıların pek çoğu finansman ihtiyaçları nedeniyle vadeli alacaklarını vadesinden önce tahsil etme ihtiyacı duyarlar. Bu nedenle poliçe kırdırma, fatura satışı veya akreditif iştirası gibi işlemler için bankalara, faktöring veya forfaiting şirketlerine başvururlar. Konvansiyonel kurumlar bu işlemleri faizli olarak rahatlıkla yapabildikleri halde Malezya dışındaki faizsiz finansal kurumlar bu işlemlerden uzak durmak zorundadırlar. Malezya’daki faizsiz finansal kurumlar bu tür işlemlerin tümünü borç/alacak satışı (bay’al-dayn) sözleşmesi yoluyla gerçekleştirirler. Makalemizde, borç/alacak satışı yoluyla gerçekleştirilen ihracat finansman yöntemleri detaylı olarak anlatılmış olup, alacak satışı yönteminin faizsiz finans prensiplerine uyumu araştırılarak alternatif ürün önerileri sunulmuştur.

Foreign Trade Practices Based on Sale of Debt (Bay’al-Dayn) and Compliance With Interest-Free Finance Principles

Abstract

Many of the exporters need to collect their receivables before their maturity due to their financing needs. For this reason, they apply to banks, factoring or forfaiting companies for transactions such as bill of exchange break, invoice sales or letter of credit negotiation (purchasing). Although conventional institutions can easily carry out these transactions with interest, interest-free financial institutions outside of Malaysia have to stay away from these transactions. Interest-free financial institutions in Malaysia carry out all such transactions through a sale of debt (bay'al-dayn) contract. In our article, export financing methods through the sale of dent are explained in detail, and alternative product suggestions are presented by investigating the compatibility of the debt sale method with the principles of interest-free finance.
