Birleşmiş Milletler Uluslararası Adalet Divanı Kararlarının Birleşmiş Milletler Güvenlik Konseyi Aracılığıyla Uygulatılması

Abstract

Birleşmiş Milletler’in (BM) her üyesi, taraf olduğu tüm uyuşmazlıklarda,

Uluslararası Adalet Divanı’nın (UAD) kararına uymayı

yükümlenir. Bir uyuşmazlığın taraflarından biri, UAD’nın verdiği bir

hükme göre kendisine düşen yükümlülükleri yerine getirmezse, öbür

taraf BM Güvenlik Konseyi’ne başvurabilir. Konsey de gerekli görürse,

hükmün yerine getirilmesi için tavsiyelerde bulunabilir ya da alınacak

önlemleri kararlaştırabilir. Eldeki makale UAD’nın kararlarının BM Güvenlik Konseyi’ne başvurularak uygulatılmasını konu edinmektedir.
