Innovations in Church Law with the Last Apostolic Constitution “Vultum Dei Quarere” Regulating the Contemplative Life of Women

Abstract

The aim of this study is to examine the new regulations that came with a document named Vultum Dei Quarere (Seeking the Face of God) promulgated by Pope Francis on 29 June 2016 in order to reorganize the rules regarding the monastic life of women who choose the ascetic life in many respects. With this document, the provisions of the old documents regulating the monastic life of women were derogated, some laws were updated, new laws were established and solutions were brought to modern problems. In this document, the issues related to monastic life were handled from twelve perspectives and the basis for new reforms was formed. Topics were outlined under the headlines of formation, prayer, the centrality of the word of God, the sacraments of Eucharist and Reconciliation, fraternal life in the community, autonomy, federations, cloister, work, silence, communication media, and asceticism. It has been announced that detailed laws will be introduced with a regulation to be issued in the coming years. Two years later, on April 1, 2018, an Instruction called Cor Orans (A Praying Heart) was prepared. This regulation is a very comprehensive document that regulates many areas of monastic life with special laws as well as containing general provisions and framework laws. In our study, other papal documents that brought order to the monastic life were also examined in a comparative way and the concluding of the Canon Law regarding the monastic life of the nuns were analyzed by touching upon important headings.

Kilise Hukukunda Kadınların Manastır Hayatını Düzenleyen Son Papalık Genelgesi ‘Vultum Dei Quarere’ ile Gelen Yenilikler

Abstract

Öz: Bu çalışmanın amacı münzevi yaşamı seçen kadınların manastır hayatına dair kaide ve kuralları birçok açıdan yeniden düzenlemek için Papa Francis tarafından 29 Haziran 2016 tarihinde yayınlanan Vultum Dei Quarere (Vechullah’ı Aramak) isimli bir belge ile gelen yeni düzenlemeleri incelemektir. Bu belgeyle birlikte kadınların manastır hayatını düzenleyen eski genelgelerin hükmü kaldırılmış, bazı yasalar güncellenmiş, yeni yasalar tesis edilmiş ve modern problemlere çözümler getirilmiştir. Bu belgede manastır hayatı ile ilgili hususlar on iki açıdan ele alınarak yeni reformların zemini oluşturulmuştur. Bunlar; eğitim, ibadet, Tanrı’nın sözleri, Evharistiya ve Günah çıkarma, cemaatle birlikte kardeşçe yaşam, özerklik, federasyonlar, kapalı mekân türleri, çalışma, sessizlik, iletişim kanalları ve asketik yaşam başlıkları altında genel hatları belirtilmiş ve ileri yıllarda çıkartılacak bir yönetmelik ile detaylı yasaların geleceği ilan edilmiştir. İki yıl sonra 1 Nisan 2018 tarihinde Cor Orans (Dua Eden Bir Kalp) isimli bir yönetmelik hazırlanmıştır. Bu yönetmelik genel hükümler ve çerçeve yasalar içermesinin yanı sıra özel kanunlarla manastır hayatının birçok alanını düzenleyen oldukça geniş kapsamlı bir belgedir.. Araştırmamızda manastır hayatına intizam getiren diğer papalık dokümanları da mukayeseli bir biçimde incelenmiş ve rahibelerin manastır hayatıyla ilgili Kilise Hukukunun nihai hükümleri önemli başlıklar altında analiz edilmiştir.
