Toplumsal Cinsiyet ve Profesyonelleşme: Hukuk Mesleğinde Kadın Örneği

Abstract

Profesyonel mesleklere kadınların katılımının tüm dünyada 19. yüzyılın ortalarına kadar oldukça sınırlı kalmış olması gerek yasal düzenlemelerin kadını görmemesinin gerekse de toplumsal, ekonomik, kültürel ve siyasi birtakım engellerin bir sonucu olarak görülebilir. Kadınların mesleğe katılımları zaman içerisinde istikrarlı bir biçimde artmış görünse de, diğer profesyonel mesleklerde gözlemlenen toplumsal cinsiyet eksenli tabakalaşma hukuk mesleği için de söz konusu olmuştur. Türkiye'de de bu tabakalaşmanın gerek hukuk alanında çalışan farklı meslek alanları arasında gerekse de aynı meslek içerisindeki iktidar konumlarının dağılımında tecrübe edildiği görülmektedir. Bu makalede, genel olarak profesyonel mesleklerde özel olarak da hukuk mesleği içerisinde kadınların durumuna ilişkin bir değerlendirme yapılacak, zaman zaman konuya ilişkin olarak Türkiye özelinde tespitler sunulacaktır.

Gender and Professionalization: The Example of Women in the Legal Profession

Abstract

The limited participation of women in professional life until mid 19th century is a consequence of restrictive legal regulations as well as social, economic, cultural and political barriers. Although the number of women has increased steadily over the years, as in other professions gender based stratification can also be observed in the legal profession. In Turkey, this stratification has been observed between different occupations in the field of law as well as in the distribution of power positions within the same occupation. This article offers an assessment of the limited participation of women in professional life with a focus on the legal profession accompanied by specific examples from Turkey.
