The Evolution of Genocide Law: An Examination on the Role of the Bosnian War

Abstract

This article critically examines the impact of legal proceedings conducted within the realm of
international law pertaining to the 1992-1995 Bosnian War on the evolution of international
genocide law. It explores the developments and challenges in implementing the Convention
on the Prevention and Punishment of the Crime of Genocide, the implications of the war on
the international legal framework, and the role played by international institutions such as the
International Court of Justice. Through a methodical analysis of pivotal provisions in relevant
court decisions, the article scrutinizes the intersection of legal responsibilities, state
sovereignty, and the politicization of genocide within the international community.

Soykırım Hukukunun Evrimi: Bosna Savaşının Rolü Üzerine Bir İnceleme

Abstract

Bu makale, 1992-1995 Bosna Savaşı ve Sırbistan'a karşı yürütülen hukuki süreçlerin uluslararası soykırım hukukunun evrimine etkilerini incelemektedir. Soykırımı Önleme ve Cezalandırma Sözleşmesi'nin uygulanmasındaki gelişmeleri ve zorlukları, savaşın uluslararası hukuk sistemine etkisini ve Uluslararası Adalet Divanı gibi uluslararası kurumların rolünü, ilgili mahkeme kararlarının öne çıkan hükümlerinin hukuki analizi yöntemiyle değerlendirmiştir. Makale, hukuki sorumluluklar, devlet egemenliği ve uluslararası camiada soykırımın siyasallaşması arasındaki kesişimi kritik bir şekilde analiz etmektedir.
