COMPARISON OF ISLAMIC LAW RULES WITH INTERNATIONAL HUMANITARIAN LAW RULES ON PRISONERS OF WAR

Öz

Legal problems arising in the international area are tried to be solved by applying written and unwritten rules of international law. However, it seems that current principles, rules and practices are not always sufficient to solve these problems. Different legal systems around the world are used to solve problems in these areas where they are inadequate. One of these different legal systems is the Islamic Legal System with its principles, rules and practices. The purpose of the emergence of Islam, which literally means “peace, salvation and well-being”, is the peace, salvation and well-being of humanity. In order to solve the problems faced by humanity, the principles, rules and practices brought by Islam are used in international humanitarian law, as in all fields. Because written and unwritten rules regarding captives in Islamic law were established 1400 years ago. On the other hand, the rules regarding prisoners in modern international humanitarian law began to be written down only in the early 20th century. In this respect, it should be benefited from the accumulation of Islamic law regarding captives. The studies carried out on this subject so far have been handled mostly by Islamic jurists. For this reason, there is a need for a study that addresses the humanitarian law rules regarding prisoners in more detail. In the study prepared for this purpose, the principles and rules stipulated in Islamic law regarding prisoners are compared with the principles and rules in humanitarian law. This comparison is made in terms of resources, the concept of captivity, principles, the treatment to be applied to captives and the ending of captivity. In this context, relevant verses, hadiths and other sources, which are the sources of the rules of Islamic law regarding captives, are discussed. Similarly, the relevant principles and rules in the 1949 Geneva Convention Concerning the Treatment of Prisoners of War (Convention III) and the 1977 Additional Protocol I Concerning the Protection of Victims in Armed Conflicts, which are the main sources of humanitarian law regarding prisoners, are examined.

SAVAŞ ESİRLERİ KONUSUNDA İSLAM HUKUKU KURALLARI İLE ULUSLARARASI İNSANCIL HUKUK KURALLARININ KARŞILAŞTIRILMASI

Öz

Uluslararası alanda ortaya çıkan hukuki sorunlar, yazılı ve yazılı olmayan uluslararası hukuk kurallarının uygulanmasıyla ile çözülmeye çalışılmaktadır. Ancak mevcut ilke, kural ve uygulamaların bu sorunları her zaman çözmeye yetmediği görülmektedir. Yetersiz kalınan işbu alanlardaki sorunların çözümü için dünyadaki farklı hukuk sistemlerinden yararlanılmaktadır. Bu farklı hukuk sistemlerinden birisi de ihtiva ettiği ilke, kural ve uygulamaları ile İslam Hukuk sistemidir. Kelime olarak, “barış, kurtuluş ve esenlik” anlamlarına gelen İslam’ın ortaya çıkış amacı, insanlığın barışı, kurtuluşu ve esenliğidir. İnsanlığın karşılaştığı sorunların çözümü için, bütün alanlarda olduğu gibi uluslararası insancıl hukukta da, İslam’ın getirdiği ilke, kural ve uygulamalardan yararlanılmaktadır. Çünkü İslam hukukunda esirlerle ilgili yazılı ve yazılı olmayan kurallar 1400 yıl önce konulmuştur. Buna karşılık modern uluslararası insancıl hukukta esirlere dair kurallar, ancak 20.yüzyıl başlarında yazılı hale getirilmeye başlanmıştır. Bu yönüyle İslam hukukunun esirler ile ilgili bu birikiminden yararlanılması gerektiği söylenmelidir. Şimdiye kadar bu konuda yapılan çalışmalar, daha çok İslam hukukçuları tarafından ele alınmıştır. Bu nedenle esirler ile ilgili insancıl hukuk kurallarını daha ayrıntılı ele alan çalışma ihtiyacı kendini göstermektedir. Bu amaçla hazırlanan çalışmada, esirler konusunda İslam hukukunda öngörülen ilke ve kurallar ile insancıl hukukta bulunan ilke ve kurallar karşılaştırılmaktadır. Bu karşılaştırma, kaynaklar, esir kavramı, ilkeler, esirlere uygulanacak muamele ve esirliğin sona ermesi halleri bakımından yapılmaktadır. Bu kapsamda İslam hukukunun esirlere ilişkin kurallarının kaynakları olan ilgili ayet, hadis ve diğer kaynaklar ile insancıl hukukun esirlere ilişkin temel kaynakları olan 1949 tarihli Harp Esirlerine Yapılacak Muamele ile İlgili Cenevre Sözleşmesi (III.Sözleşme) ve 1977 tarihli Silahlı Çatışmalarda Mağdurların Korunmasına İlişkin I. Ek Protokol’deki ilgili ilke ve kurallar incelenmektedir.
