Greece, which is located on the southeastern border of the European Union (EU), was affected by the political chaos deriving from the Arab Spring that started in 2010 and was exposed to mass migration movements. These migration movements have inflamed discussions on the migration and asylum system of Greece, which has been constructed in accordance with acquits at the national and the European Union level. The reports of Human Rights Watch, international amnesty organization, and several decisions of the European Court of Human Rights (ECHR) demonstrate that Greece threats the right to life of asylum seekers, resorted to acts unworthy of human dignity, and violated the prohibition of torture during the struggle against irregular migration. This paper aims to put forward systematic human rights violations against asylum seekers by Greece and discuss the approach of the ECHR. It consists of three sections. First of all, the general lines of the asylum system of Greece will be summarized and the implemented immigration policy will be discussed. Secondly, the human rights violations that Greece's asylum system creates in practice will be revealed, and in the final part, how these violations are evaluated by the ECHR will be examined and the consistency of these decisions with the official reports of international non-governmental organizations will be compared. This paper argues that Greece adopted a reactionary and security-oriented attitude and also considers factors such as national identity, domestic politics, and security rather than Europeanization while constructing the immigration and asylum system. It claims that the acts, which are deriving from this point of view, violating fundamental human rights while struggling with irregular migration, are legitimated by Greek authorities and it is the subject of many cases in the ECHR.
