MALTA ASKERÎ EGEMEN DÜZENİ’NİN DİPLOMATİK İLİŞKİLERİNE DAİR GENEL BİR DEĞERLENDİRME

Abstract

Günümüzde, uluslararası hukuk kurallarına göre merak uyandırabilen birçok olay vardır. Merak uyandırma fenomeni, Ortaçağ’dan beri hukukî statülerini devam ettirmeleri, yâni Ortaçağ döneminin kalıtı olarak zamanı geçmiş kavram ve algıların ürünü olaylar olmalarından kaynaklanmaktadır. Böylelikle, yapılarının büyük bölümü uluslararası hukukun modern kurallarına uymamaktadır. Bunlardan biri Malta Düzenidir. Açık olarak devlet olmayan Düzen, bir devlet gibi davranmaktadır. Malta Düzeninin, aktif ve pasif elçilik hakkını kullanması suretiyle bir devletmiş gibi hareket ettiği temel konulardan biri diplomasi hukukudur. Bu açıklamaların ışığında, bu makalenin amacı Malta Düzeni’nin diplomatik ilişkilerini kısaca analiz etmektir.
